Riot police guard Poland's Constitutional Tribunal in Warsaw after the government suspends two senior justices and moves to bring criminal charges against them.

A tense political stand-off has developed in Warsaw surrounding Poland's Constitutional Tribunal, with riot police deployed to secure the building as opposition politicians protested outside. The crisis escalated after the government suspended the court's two senior justices and initiated steps to bring criminal charges against them.

Polish Justice Minister Waldemar Żurek stated that he requested the removal of parliamentary immunity for both the court's President Bogdan Święczkowski and Vice-President Bartłomiej Sochański. The minister argued that the senior officials should face prosecution for refusing to permit newly elected judges to adjudicate cases.

Riot police secure Poland's Constitutional Tribunal amid a major political clash over the judiciary.

In response to the actions, the Constitutional Tribunal issued a statement on social media declaring that the two men remain the legally appointed senior justices and asserted that participants in the government's moves were committing a coup d'état. Meanwhile, right-wing opposition politicians from the Law and Justice party gathered at the premises to demonstrate against the suspension.

Prime Minister Donald Tusk defended the measures, stating on social media that restoring the rule of law is a necessary duty following years of previous lawlessness. Tusk took office in 2023 with a pledge to depoliticise the judiciary, though his administration has faced hurdles due to presidential vetoes and ongoing institutional disputes originating from reforms enacted after 2015.

Legal experts have expressed concern regarding the unfolding situation. Prominent lawyer Marcin Matczak criticized the suspension as lacking legal basis and warned that the intervention involving armed police could generate negative repercussions for the judicial system for years to come.

Why it matters

The escalation at the Constitutional Tribunal deepens Poland's long-running rule of law crisis, affecting the country's governance, judicial independence, and political stability ahead of parliamentary elections next year.
