Home Secretary Shabana Mahmood has revised tough immigration proposals, allowing thousands of care workers to qualify for settlement after five years following a political backlash.

British Home Secretary Shabana Mahmood has adjusted controversial immigration proposals regarding low-paid workers after facing intense pushback from cabinet ministers, trade unions, and backbench Labour MPs. Under the revised framework, up to 300,000 people, including care workers and their dependants, will be able to apply for indefinite leave to remain after five years instead of facing an extended waiting period.

Initial proposals drawn up last year suggested that workers in occupations below degree level would face a 15-year wait before becoming eligible for permanent settlement. However, following strong opposition from health unions and senior Labour figures such as housing secretary Angela Rayner and London mayor Sadiq Khan, most workers have been spared the maximum 15-year requirement. A Home Office response published on Monday confirmed that workers below RQF Level 6 will qualify through a ten-year pathway or sooner if they meet requirements for an accelerated route.

The revised rules establish distinct tiers based on earnings and entry methods. Care workers earning more than £25,000 will be eligible to apply for settlement after five years, covering an estimated 146,000 care workers and 136,000 dependants. Meanwhile, about 100,000 skilled workers such as butchers and chefs face a ten-year wait. Individuals arriving in breach of immigration rules face stricter penalties, with small boat arrivals reliant on public funds facing a minimum 30-year wait for permanent settlement.

Care workers earning over £25,000 can now apply for indefinite leave to remain after five years.

Shifting Stance on Settlement

The debate over immigration timelines intensified as migrants who arrived during the administration of Boris Johnson reach the five-year threshold. Analysis published on Monday by the Institute for Public Policy Research indicated that skilled migrants settling in the UK are projected to make a net lifetime contribution of about £115bn through taxes. Mahmood met with union general secretaries on Monday to finalize details of the consultation response, maintaining that permanent settlement remains a privilege that must be earned through contribution and integration.

Why it matters

This policy shift directly impacts hundreds of thousands of migrant workers, particularly within the social care sector, by removing the threat of a prolonged 15-year wait for permanent residence. The decision relieves immediate pressure on social care providers while balancing government goals to regulate immigration timelines based on earnings and compliance with entry rules.
