The central government has updated immigration rules to exempt certain foreign nationals, including specific groups from Pakistan and Bangladesh, from standard passport requirements.

The Union Home Ministry has published an amended order granting exemptions from certain passport and visa mandates for several categories of foreign individuals living inside the nation. The new directive was issued on a Thursday, bringing relief to specific groups such as minority refugees, Sri Lankan Tamils, Tibetans, and select citizens originating from Pakistan and Bangladesh. This policy shift applies to individuals who came to the country lacking valid travel documents, alongside those whose passports or identification papers have since expired.

The regulatory update extends relief to six distinct religious minority communities hailing from Afghanistan, Bangladesh and Pakistan. This framework specifically encompasses Hindus, Sikhs, Buddhists, Jains, Parsis, and Christians who arrived in India by December 31, 2024, following religious persecution or the fear of it. Furthermore, the provisions apply to people who settled here with the intention of remaining permanently.

Understanding Pakistan Bangladesh Immigration Updates

To qualify for these specific reliefs, applicants must satisfy a series of mandatory conditions. Eligible individuals must not have married while residing in Pakistan, nor are they allowed to acquire any immovable property there. Additionally, they must have left behind family members who hold Indian citizenship when they travelled to Pakistan, provide an undertaking confirming they will not return, and possess clean records free of any adverse reports from police or security agencies. Meanwhile, Pakistani nationals who established residency in India by December 31, 2009, might be excused from regular passport renewal norms if they cannot secure a fresh travel document due to the absence of a Computerised National Identity Card issued by Pakistan.

The updated order also covers registered Sri Lankan Tamil refugees who reached India by January 9, 2015, permitting them to stay without fulfilling usual passport and visa obligations. Similarly, Tibetan nationals who arrived through specific entry permits issued by the Indian embassy in Kathmandu between 1959 and May 30, 2003, or those entering after the latter date via designated checkpoints along the India-Nepal border using special entry permits, are included in the exemptions.

Relaxed passport rules do not grant automatic indefinite stay or remove all immigration requirements.

Why it matters

This policy adjustment alters how specific refugee and migrant groups manage their legal status within the country, addressing longstanding documentation hurdles for vulnerable populations from neighboring regions. Even with these exemptions, beneficiaries must still secure an appropriate visa after entering if they wish to prolong their stay, ensuring that core immigration protocols remain active.
