The US Justice Department filed a lawsuit against Pennsylvania State University over a policy that grants in-state tuition to undocumented students.

The United States Department of Justice has initiated legal action against Pennsylvania State University, alleging the educational institution breached federal regulations. According to the complaint, the university provides reduced in-state tuition rates to undocumented students while denying these same financial benefits to United States citizens from other regions. The federal filing argues that this institutional approach creates discrimination against citizens.

Under current guidelines, undocumented students can access lower tuition fees by fulfilling specific residency criteria set by the university. However, federal prosecutors contend this practice contradicts a federal statute prohibiting preferential treatment for undocumented individuals in higher education unless identical benefits remain accessible to all American citizens. Public universities traditionally charge lower rates to local state residents who contribute through taxes, while out-of-state students pay higher fees.

Proponents of reduced tuition for local residents argue the practice prevents regional brain drain and rewards tax-contributing families. Conversely, advocates maintain that providing similar financial relief to undocumented individuals, many of whom arrived in the nation as minors, helps eliminate educational barriers.

The Justice Department seeks to block Penn State from offering reduced tuition to undocumented students.

The federal agency is requesting a court order to halt Penn State from extending in-state tuition rates to undocumented individuals regardless of their local residency. Prosecutors also want to prevent the implementation of future tuition policies that provide preferential treatment over citizens. Brett Shumate, assistant attorney general of the Civil Division, stated that Congress explicitly decided states and public institutions cannot grant tuition advantages to illegal aliens unless matching benefits apply to all US citizens.

This legal challenge forms part of an expanded initiative under President Donald Trump to question state-level tuition policies for undocumented students. Since returning to office for his second term in 2025, Trump has prioritized restrictive immigration enforcement. The Justice Department notes this filing represents the twenty-seventh lawsuit targeting such policies, with six jurisdictions already securing permanent blocks via court orders.

Prosecutors maintain that provisions like the 1996 Personal Responsibility and Work Opportunity Reconciliation Act prevent public benefits from acting as incentives for undocumented immigration. Penn State officials confirmed receipt of the complaint and stated they are currently reviewing the matter.

Why it matters

The federal lawsuit challenges established local residency pathways at higher education institutions, directly impacting how public universities balance state-level tax contributions with federal immigration statutes. For students and academic administrators, the outcome could redefine tuition accessibility frameworks nationwide.
