A new Labor Department proposal regarding 401k retirement plans has reached the White House for final review, potentially opening the door for a wider range of digital assets. While the initiative does not explicitly exclude altcoins or smaller cryptocurrencies, industry experts suggest that integrating these assets into retirement accounts will face significant hurdles compared to established options like Bitcoin and Ether.
Understanding the 401k proposal
The rule aims to simplify the process for retirement plans to offer alternative investments while providing enhanced legal protections for employers and plan managers. Although the proposal does not mandate a minimum market capitalization for included assets, it directs plan managers to evaluate potential investments based on six core criteria: performance, fees, liquidity, valuation, benchmarks, and complexity. Teresa Goody Guillรฉn, managing partner at Bellementis PLLC, noted that while Bitcoin and Ether are likely to be the first assets offered due to their established market presence, the proposal does not automatically disqualify smaller tokens. Instead, she emphasized that the primary concern is whether an investment meets the standards of prudence and investor protection expected of any retirement option.
The proposed rule allows for broader crypto inclusion but places the burden of proof on plan managers.
Bernardo Brites, CEO of Trace Finance, suggested that the practical test for inclusion will be the ability to document a reliable, daily price through a regulated wrapper. He argued that many smaller tokens may struggle to meet these rigorous benchmarks. Furthermore, experts anticipate that the rollout of these investments will be gradual. Managed funds and exchange-traded funds (ETFs) are expected to arrive before direct crypto holdings, as they integrate more easily into existing custody and recordkeeping infrastructure. Brites projected that while some options might appear in 2027, broader availability in retirement funds may not occur until 2028, noting that while the rule addresses legal risk, the underlying operational systems remain slow to adapt.
Beyond technical and operational constraints, legal uncertainty persists. Although the proposal offers a degree of protection, it does not grant complete immunity from litigation regarding investment decisions. Additionally, there is the risk that future administrations could reverse the guidance, which may cause employers to remain cautious about incorporating crypto into long-term retirement planning.
Why it matters
This proposal marks a potential shift in how retirement savings are managed by allowing for alternative digital assets, though it places a heavy responsibility on plan fiduciaries to justify their choices. If finalized, the rule could influence how employers structure their offerings, though the practical implementation remains subject to legal, operational, and political variables.
