A federal magistrate judge dismissed criminal charges against two former FBI officials accused of making false statements regarding the Hunter investigation.

A federal magistrate judge has dismissed criminal charges against two former FBI officials who were accused of lying about their involvement in the investigation concerning Hunter, the son of former president Joe Biden. Magistrate Judge Zia Faruqui ruled on Monday that prosecutors failed to establish probable cause showing that the former officials, Nikki Floris and Bradley Benavides, knowingly provided false statements to lawmakers.

Floris and Benavides were charged last month by federal prosecutors in Washington DC with making false statements to members of Congress during 2023 testimony before the House judiciary committee. Their testimony focused on the bureau’s role in reviewing the contents of a laptop belonging to Hunter Biden. Both individuals previously served on an FBI taskforce formed after the 2016 presidential election to examine potential foreign influence in American politics.

During the court hearing, Judge Faruqui criticized federal prosecutors for rushing the legal process and making critical mistakes, suggesting the charges were brought at a sensitive time just ten days before the midterm elections. Faruqui stated that the situation could not be described as anything other than weaponization and noted that some statements attributed to the former officials were not actually false, while others stemmed from honest memory lapses. Testimony last week indicated that the probe into Floris and Benavides began following a July presidential address on election security delivered by President Joe Biden, after which FBI Director Kash Patel tasked the Kansas City field office with scrutinizing Floris over her doubts regarding an intelligence report about Chinese meddling in the 2020 election.

Federal prosecutors failed to prove former FBI officials knowingly made false statements about the laptop probe.

While the justice department complaint has now been dismissed, prosecutors retain the option to seek new charges by presenting evidence to a grand jury for review. Since returning to office in January 2025, the justice department has targeted individuals viewed as political adversaries by Donald Trump through various indictments and complaints, though several high-profile attempts have failed to yield results.

Why it matters

The dismissal highlights ongoing legal battles surrounding federal oversight and investigations into the 2020 presidential election cycle. This decision impacts accountability measures within federal agencies and shapes how past intelligence taskforce actions are scrutinized by the courts.
