Concerns are rising over a sharp increase in rejected residency applications for Turkish nationals, drawing comparisons to the Windrush scandal.

Concerns have been raised over a sudden and sharp increase in rejected residency applications for Turkish nationals facing removal from the UK. The situation has prompted serious accusations that the Home Office has failed to learn the lessons of the Windrush scandal. Since the start of the year, there has been a significant surge in refusals for indefinite leave to remain among individuals holding European Community Association Agreement visas. This longstanding residency route allows Turkish nationals to set up businesses in the UK. The rise in refusals appears to affect applications lodged since September 2025, shortly before controversial proposals for tougher conditions were announced at the Labour conference. Hundreds of ECAA holders have been refused permanent residency since January, representing a major uptick compared with previous years. Meanwhile, successful applications have plummeted from several thousand to just a few hundred. Refusal letters have reportedly been riddled with basic errors, made-up requirements, and a disregard for human circumstances that were previously handled with discretion. Among those affected is a woman whose application was denied because she chose to undergo cancer treatment in Turkey during the pandemic after medical advice warned that transferring her clinical care carried significant clinical risk. Despite a review, the Home Office informed her that she and her three young children should leave the country. Another applicant was told his window-cleaning business lacked legitimacy due to an absence of a social media presence, a requirement that does not exist. David Lammy, the former foreign secretary and MP for Tottenham, has raised concerns after errors were found in rejected applications. He noted that the situation had devastated the lives of those affected and evoked memories of the windrush scandal. Legal professionals have pointed out that Home Office caseworkers appear to be making significant errors, such as incorrectly calculating days spent out of the country or falsely claiming applicants failed to provide complete bank statements. Data shows that grants of settlement for ECAA applicants fell from 3,378 between January and June 2025 to just 745 for the same period in 2026, marking a 78 percent drop. Administrative review processes have also seen a surge, with requests jumping significantly. A Home Office spokesperson maintained that there has been no change to how ECAA settlement applications are considered and that every case is handled on its individual circumstances in line with published rules.

Sharp rise in rejected UK residency applications for Turkish nationals draws Windrush comparisons.

Why it matters This sudden shift in residency approvals directly threatens the stability of hundreds of Turkish-origin business owners and their families who have built lives in the UK. The situation highlights ongoing administrative vulnerabilities within immigration processing, raising broader questions about fairness, adherence to independent review recommendations, and the protection of vulnerable applicants navigating permanent residency routes.
